Patrol Inspectors Frank Vidmar, Jr. and James W. Hudson were performing voluntary extra duty in the vicinity of Lewiston, New York, in an effort to apprehend a known alien smuggler. Since the government vehicle customarily used was known to the smuggler, the personal automobile of Patrol Inspector Vidmar with Hudson driving. The smuggler was encountered in his automobile, accompanied by two other persons, disregarded the command to stop and fled. The officers pursued the smuggler’s car into the city of Niagara Falls. The car skidded on the icy pavement and collided broadside with an oncoming trolley car. Patrol Inspector Vidmar received injuries resulting in his death.
